WITNESS INTERVIEW REPORT (#3) ATTORNEY: Bob Abel/ John Storkel CASE: Frank Gable INTERVIEWED: Ellen Chase 4956 13th ave.N. Keizer, Or 97303 HM: 390-0871 WK: 378-2599 buc:ellen chase On 9-13-90 this investigator contacted Ellen Chase at her employment. She stated that she recalled her statement to the police on 1-18-89. xxx buc:ellen chase She stated that she works at the dome bldg. She usually gets off work at 5:30pm. That night she left about 5:40pm. She knows that the front door is always locked when she leaves. buc:ellen chase She stated that a guy, who she feels is named Larry,locks the doors each night. He is now a custodian person at the new Baker facility. She did say that she could be wrong in that Larry may have gone to Baker prior to Michael Francke being killed. If that was the case then "Noe" who is the custodian now would have been the one xxx buc:ellen chase She usually waits at the steps for her ride. Some times she sees employees or their family members and tells them that the door on the north portico is open. Although she hasn't watched them actually go in the door she know that they don't return so she felt that they got in. xxx buc:ellen chase It was her impression that the last one out of the bldg. was the one who locked this door. She doesn't know this for sure because she is picked up real soon after 5:30pm. xxx buc:ellen chase She also stated that the board of parole workers are not allowed to work after 5:00pm. They don't want people to stay after 5:00 because they don't want to pay overtime. xxx buc:ellen chase No further information at this time.

CASE: Frank Gable SUBJECT: SEARCH/ LOCATE BODY. INTERVIEWED: Steve Rubino 4736 Elcedro Loop NE Salem, Or. HM: 371-4686 WK: 378-2348 xxx buc:steve rubino On 9-19-90 this investigator contacted Steve Rubino at the dome bldg. Steve stated that he works for the Oregon State Hospital. On 1-17-89 his job title was a Psy. Aid 3 at the Communication Center. Part of his job at the time was to help with security around the hospital grounds. They give him a Chevy van to drive. He came on duty at 10:30 pm. and he replace Dick Carlyle. xxx buc: steve rubino When he came on shift he got a briefing about the report of Michael Francke. Basically he was told that the corrections was concerned because they couldn't find Mr. Francke. He had been paged with no response. He was also told that Larry Hill, who is a maintence worker looked around the dome bldg. and had also talked to some workers inside the dome bldg. (See attached diagram for activities of Steve Rubino) xxx buc:steve rubino After the briefing Steve went to do his rounds at the hospital. He came across a VW van that was parked across center street from the dome bldg. He radioed the licence plate. After a while he went over to the dome bldg. area. xxx buc: steve rubino Steve approached from east of the dome. He parked his van at the northern circle on the east side. He was several feet away on the passenger side of Mr. Francke's car. He got out of his van and approached Francke's car to the passenger window. He stayed a foot from the car so he wouldn't touch the car. xxx buc:steve rubino He had his flashlight and shown it into the car. He felt that the car was in a messy condition and seemed cluttered. He saw the car phone, it was hung up in its carrier on the dash. He remembers thinking about being told that the car door was found open and yet the car phone was still in the car. This just passed through his mind. xxx buc:steve rubino He then moved around the rear of the car to the drivers side again staying about one foot away from the car and shining the light inside the car. He doesn't specifically remember thinking about an alarm. He doesn't remember seeing an alarm light on the dash, blinking or not blinking. xxx buc:steve rubino Steve shown the light on the ground around the car. He was specifically looking for blood. Because of the briefing about Michael Francke being missing and the fact that he had an important position with corrections Steve was alert to foul play. He also shown the flash light in and around and underneath the bushes in the circle area. xxx buc:steve rubino He then went to the front of the dome bldg. area near the steps. He is not exactly sure where he walked to get there but he feels that he probably took the most direct route across the grass area. He then went down and checked the step and door area in the well next to the north portical steps. xxx buc: steve rubino He came up from there and walked up the steps to the north portico. He remembers first seeing the body when he reached the top of the steps and took a half of a step towards the door. This is when he saw a body lying near the door. xxx buc:steve rubino He took another three of four steps towards the body to see more. This is when he called to security about a man down. Steve stated that it is not uncommon to find people sleeping around the dome bldg. He never saw blood at this time. He knew something was wrong and his initial feeling was that the body was dead. buc:steve rubino The porch area had two lights on which were working. Somehow now they seem a little brighter than that night. He is not sure if they were replaced with a higher watt bulb or cleaned the covers. He remembers that there were lights on within the bldg. but he is not sure which rooms. xxx buc:steve rubino Steve then went to his vehicle and waited for Larry Hill to come and join him. They both then went up on the porch and approaced the body a little closer. (see diagram for location) buc:steve rubino They both felt that the body was dead and they saw the blood on the wall. They stayed there for about a minute then they returned to their vehicles. They moved their vehicle to an area on the far west side on the most northern circle and waited for the police to arrive. xxx buc:steve rubino No further information at this time. xxx

WITNESS INTERVIEW REPORT (#3) ATTORNEY: Bob Abel/ John Storkel CASE: Frank Gable INTERVIEWED: Adam Hernandez Marion county jail RECORD: Conviction for PCS,(meth) In jail now for hindering prosecution. (PV) xxx buc:adam hernandez On 9-6-90 this investigator contacted Adam at the Marion Co. jail. After my introduction I showed him a police report dated 1-26-90 where it is indicated that he made statements to the police. He read this report and stated that he agreed with it. xxx buc:adam hernandez He also denied to me that he gave a ride to Jodie from Dundee, Or. on the 17th. of January 19 xxx buc:adam hernandez He stated that the cops came to the pen and interviewed him about picking up Jodie. He denied to them as indicated in the report that he picked her up. xxx buc:adam hernandez At this time I read him the report concerning his polygraph test. He indicated that he didn't lie to them. He went on to add "she is trying to get me to be some type of alibi and I'm not going for it". He stated that he has no reason to lie. xxx buc:adam hernandez He stated that he was at Shortys house one time with her. He flatly denied that he told the police that Shorty was selling him dope, as indicated in the reports. He said the he did tell the cops that he saw Shorty with all kinds of knifes, but he doesn't remember describing any one in particular. xxx buc:adam hernandez Adam stated that he would go the Hyacinth house once in a while. He did work on Shortys car there a couple of times. He met Jodie at that residence the day prior to the bust at that house on 1-20-89. He stated again that he came to the house the day prior to the bust and that was when he met Jodie. the next day the cops came and arrested everyone. No further information at this time.

Or. 363-8856 DATE OF INTERVIEWED: 9-20-90 buc:vicki boyd I contacted Vicki at our office and spoke with her. She stated that she had received a call from the DA Tom Boswick. He asked her to come to his office for an interview. She told him that she is not sure if she should do that as she is a witness for Bob Abel; "the other side" and "that would be working both sides of the fence". She stated that she knows better than that as her father was a district attorney at one time. xxx buc:vicki boyd Boswick said something about her talking to the state police and she told him that was because they had come to her door. He told her, "I think you better come on down and see me". It was at this point that she contacted Bob Abels office. xxx buc:vicki boyd She stated that the first thing that came to her attention was when she was subpoenaed to come to the Grand Jury. She was told that she might have information about Johnny Crouse because she was at the parole office the same time as him and her name was next to his on the sign in list. xxx buc:vicki boyd She said that she had no memory of these certain events happening on January 17th, 1989 until they told her. xxx buc:vicki boyd On January 17th, 1989 she went to see her parole officer at the office on center street. She didn't know the name Johnny Crouse until she was told by the cops that she was there at the same time. However when she saw some photos of Johnny Crouse she recognized him as the person she saw and talked to while at the parole office. She never knew Crouse before that day and she has not seen him since. xxx buc:vicki boyd At the Grand Jury they asked her about his actions, their conversation and what he wore. She told them that he was quiet speaking and seemed calm. He stated that he was looking for a job. She saw and talked with him for about five minutes before she went in to talk to the P.O. When she came out he was gone. xxx buc:vicki boyd Crouse was dressed casual. He looked like he might be looking for a jog. She didn't remember him having a coat with him. She does remember him wearing a plaid long sleeve shirt. They made a big deal about what socks he was wearing. She didn't know why. She said that she really didn't see his socks. She seems to remember him having on low top leather shoes. xxx buc:vicki boyd They also asked her what her opinion was about who killed Michael Francke. She told them that she wasn't sure why but she felt that it had something to do with corrections. xxx buc:vicki boyd She also remembers seeing another person at the parole office that day. Her name is Aaron Grimm. (she lives pm 19th and Market.) xxx buc:vicki boyd Vicki again stated that she remembers nothing concerning the 17th. She only know what happened at the parole office and after she left. The cops told her that it was the 17th. xxx buc:vicki boyd She stated that she was at the parole office for about a half an hour. She then went straight home. She figured this was a little before 5:00pm. She changed her clothes and then went over to Shellie Thomas's house who lived about a half a mile away from her house. She feels that she arrived there about 6:30-6:45pm. xxx buc:vicki boyd When she arrived Shellie was on the phone. She said that she was talking to Frank Gable. Vicki knew Frank from Cornerstone. Shellie handed the phone to Vicki. She talked to Frank about old times at Cornerstone. They talked for about 10 mins. Frank told her that he was on his way over there. Vicki felt that Gable was bringing over drugs because Shellie told her that she was expecting some to be brought over any moment and Gable told her he was coming over. No one actually said that but, "I sold drugs for 12 years and I know". xxx buc:vicki boyd
Vicki said that she was going to go home and get some money and she would be right back. She was at her house for about a half hour. She remembers seeing the clock at her house at 7:00pm., so she would have returned to Shellie's about 7:30pm. xxx buc:vicki boyd By the time she arrived Gable had come and gone. She told her that she had just missed him. Also Shellie now had drugs and Vicki bought some off her. Then she left. xxx buc:vicki boyd Vicki stated that she saw Shellie only once after that. She was arrested on February 10th and went to jail on a PV. She had not talked to nor seen her since. xxx buc:vicki boyd Vicki also remembers Shellie telling her that Dennis had called from California and she also said that Frank got a chance to talk with him. xxx buc:vicki boyd Vicki stated that she has been clean since February 10. She stays away from the old crowd and she has a job. xxx No further information at this time.

WITNESS INTERVIEW REPORT (#3) ATTORNEY: Bob Abel/ John Storkel CASE NAME: State vs. Gable, Frank SUBJECT: Search/ Discovery of M. Francke. SUBJECT INTERVIEWED: LARRY HILL 1745 Capitol Street SE. Salem, Or. 363-6421 Employment: Oregon State Hospital Maintenance. buc:larry hill Presently Larry has a Drunk driving conviction. He has a suspended licnce and doesn't drive a vehicle. xxx DATE OF INTERVIEW: 8-20-90 xxx buc:larry hill I met with Larry at the dome building. I asked him to review his activities on the night of 1-17-90. He stated how he had received the call and responded to the dome bldg. His statement was very close to what was contained in the police reports. xxx buc:larry hill He stated that part of his duties in maintenance is helping with security on the hospital grounds. Some times the security is busy and he is called to help. xxx buc:larry hill After the communications center got the call from the two women he drove his state Luv truck over to the dome bldg. He entered the grounds off of center street. He approached the main entrance of the dome bldg. He had a search light and was shinning it around the area. He saw nothing. He drove around the circle past the main entrance moving at a slow pace. He was doing a cursory search with the spot light. He never got out of his truck. (see attached diagram) xxx buc:larry hill When Larry had been by the dome building around 6:00 pm the parking circle was filled with cars. Now at 8:00 pm during this time there were only two cars parked at the circle. One car was Michael Francke's (He didn't know at the time it was Francke's) and another vehicle which was parked across the circle from Mr. Francke's. (see attached diagram) xxx buc:larry hill He continued through the parking lot behind the hospital, circled around to come up on the north side of the dome bldg. He stated that he doesn't remember now seeing the women leaving the dome bldg., down the steps. However he does remember seeing the women get into the other vehicle that was parked at the circle. She then drove out to center street leaving Mr. Francke's vehicle as the only one parked at the circle. Larry felt that this women was one of the women who had originally called the communications to report seeing Mr. Francke's car and the door open. xxx buc:larry hill Larry then returned about 9:30 pm. He felt that he should check again but didn't really feel he would find anything. This time he again came to the top of the circle in front of the dome main entrance. He saw two vehicles parked, one on each side of Francke's car. He saw two men just inside the main entrance doors. He then left his truck and ran up the steps, entered the main doors and talked to the men. He asked them if they were Francke. They said no, that they were looking for him. Larry knew one of the men by sight. Larry had seen him around the dome bldg. when he had worked at the dome. The other person, Larry didn't recognize. All three then walked up the hall way towards the area of Francke's office. When they were at the end of the hall Larry returned to his truck and left the area. xxx buc:larry hill Larry then made the rounds again about 10:30 pm. Francke's vehicle was the only one at the circle. Larry saw that there were lights on in Francke's office. He didn't think that was real strange because those lights were left on often. xxx buc:larry hill He went by again at the end of his shift and saw no change. Francke's car was in the same location and appeared untouched. xxx buc:larry hill At this point I read the police report to him which he agreed except for the point about seeing the women leave the building. He doesn't recall actually seeing he come down the steps. He only remembers seeing her get in the car and drive away. xxx buc:larry hill Regarding the statement about the lights being dim on the north portico, he was comparing that to the next night when they seemed brighter. He just felt that maybe some one had put in new bulbs. No further information at this time.

HM: 749-1558 WK: 378-2361 buc:meril craig On 9-17-90 this investigator contacted Meril Craig at the dome bldg. At that time I reviewed with him a police report dated 1-23-89 where he had made statements to the police. He indicated that it was correct. xxx buc:meril craig On 1-17-89 Meril was a maintence worker. Part of his duties are to respond to emergence situations and help out the corrections security. He works the night shift. When he came on duty he replaced Larry Hill. xxx buc:meril craig When he came on duty the 17th. he was told that Michael Francke was thought to be missing and his car door was found open. When he did his rounds he came across a VW van parked across center street from the dome bldg. He felt that it was not too out of place as other cars have been left over night on the hospital property before. xxx buc:meril craig He then went to where Michael Francke's car was parked. He stopped near it, on the passenger side not in the parking stall next to it but in the driveway area. xxx buc:meril craig He got out of his vehicle and using his flash light looked inside the car. He felt that it was probably the passenger side as that was the side he was on. He did walk around and look inside on the drivers side also. He was looking for signs of why it was there and the possibility that it had been broken into. He saw the car phone and was surprised that it was still there because he had heard about the car door being open. He doesn't remember the position of the phone he just remembers it being there. He does feel that if it was out of its holder he would have remembered that. He didn't touch the car at any time. buc:meril craig Meril doesn't remember seeing a light on the dash, and he had no thoughts of an alarm in the vehicle. xxx buc:meril craig Meril stated that he and Steve Rubino talked about the VW van and Michael Francke's car. Steve stated that he was going to make the rounds and check it out. A little while later he received a call that a man was down. buc:meril craig Meril met Steve at the dome bldg. They both went up on the steps to see the body. They approached the body but staying a ways away. They wanted to check if the person was dead. He appeared to be dead from his position. (see attached photograph) xxx buc:meril craig While we were up on the north portico Meril marked the photograph with an "X" indicating the locations where he could first see the body (from the steps) and the area he was at when he viewed the body. No further information at this time.

Salem, Or. 370-9647 xxx DATE OF INTERVIEW: 8-23-90 xxx buc:susan honan I contacted Susan at her home to review her statements about Michael Francke. We started the interview by her reading the police report (see attached report) and making any comments. xxx buc:susan honan BASEBALL BAT: She stated that she didn't see him taking the garbage out with his baseball bat, but Bingta told her about the incidents. She stated that the subject came up during the following conversation. xxx buc:susan honan Francke's had a skate board ramp that their son would use with his skate board. The kids in the neighborhood wanted to use the ramp so they would come by and asked them if they could use it. Some times they would peer over the hedge and try to see if the son was home. Michael and Bingta didn't like that. Bingta called her one day and said that she knew that Susans sons wasn't looking over the hedge but she wanted to let Susan known that it wasn't a good idea. Bingta was hoping that Susans son would pass the word along to the other kids. xxx buc:susan honan They didn't feel it was good for the boys to be looking over the hedge and maybe coming in the yard. Bingta said that Mike was so nervous that he might mistake the boys for someone else and shoot them or some other mistake. xxx buc:susan honan ALARM: Susan stated that Francke never showed her the alarm system. She remembers hearing the alarm go off. Bingta came over and was excited and told Susan that they had gotten a new alarm. Bingta also told Susan how alert they were to security measures. She talked about the system they used to lock everything up when they left the house. She told her about how they check everything and make sure that the windows are locked. xxx buc:susan honan Susan then commented how aware they were of the surroundings. They were always alert to what was happening. She told me about one time when the Francke's were first in town. They were walking past her house and saw the front door open. They approached the front door to see if anything was wrong. Francke said that he had to check stating, "I'm just that way". SPRAY PAINTING THE HOUSE: Susan commented that there had been two persons who had painted the house. Bingta took her out to show her the damage and two separated foot prints where obvious.
Bingta said, "you can see where this one stood and used his right hand and the other one stood here and used his left hand". If was real clear that one was left handed and one was right handed. xxx buc:susan honan Also, there were paint drippings out in the street where they had loaded the spray machine. xxx buc:susan honan Susan then stated that she had never met anyone more aware of security than they were. It was just a way of life with them. xxx buc:susan honan She said that she doesn't feel that only one person killed Francke. He was physically active. He was a double diamond skier, and rode dirt bikes. She said that he was too aware of his surroundings to get caught by one person. The story that the district attorney seems to be saying isn't very realistic. xxx buc:susan honan CARS ACROSS THE STREET: She stated that the time that some guy was parked across the street she was sure they were watching the Francke house. Bingta called her and asked if she could see the licence plate on the car. The man in the car was continually looking over at the Francke house. He stayed there for 2-3 hours and then was replaced by another car with another guy. The guy stayed a couple of hours also. xxx buc:susan honan NEW MEXICO INCIDENT: Bingta told her about this incident. This happened while they were living in New Mexico. Bingta was telling her about the fight incident and the incident while shopping because she was saying how glad she was to get out of New Mexico. She said that these are just some of the reason why she wanted to leave. xxx buc:susan honan Bingta told her how the guy had accused Francke of dealing drugs. Francke was going to fight the guy. He stood up took off his glasses and taking off his coat but was stopped by Bingta. xxx buc:susan honan This guy ended up being just a nobody and the police were not involved. The Francke's just left the restaurant. No further information at this time.

WITNESS INTERVIEW REPORT (#3) ATTORENYS: Bob Abel/ John storkel CASE NAME: Frank Gable SUBJECT: Prison Inmate INTERVIEWED: Freddie Smith 407 N. Grove Southerland, Or. 459-2443 xxx buc:freddie Smith On 9-11-90 this investigator contacted Freddie at his residence. He stated that he was at OSP and was released January 12, 1990. xxx buc:freddie Smith While he was in prison he was working on an inmate crew that worked at the dome bldg. He remembered that the day Michael Francke was killed he, along with several other inmates were standing outside the dome bldg. on the steps. It was around 4:00pm. He saw Francke come out of the north portico doors and jog in the direction of his car. Freddie didn't actually see Francke at the car. He wasn't paying attentions. Freddie assumed that Francke went to his car because he was gone about a half a minute and then came jogging back with some papers in his hand. xxx buc:freddie Smith Freddie stated that Francke was in his shirt sleeves and was holding a series of papers in his hand. Freddie said, "there's Mr. Francke jogging in his shirt sleeves". Francke said "hi Fred" and held up his hand with the papers in it as a waive to him. buc:freddie Smith Freddie said that he works in the dome bldg. second floor. His office is at the top of the stairs just as you enter the door on the south side. The last 2-3 days before Francke's death, Freedie say Francke going back and forth from his office to the library. As Francke passed by Fred's office a couple of times he would say hi to Fred. Francke went back and forth several times a day. He spent a good part of the day at the computer. Freddie figured that he was working on something important just because of the way he was going back and forth and seemed to be working feverishly. xxx buc:freddie Smith Freddie stated that in his office was the shredder. He would shred some papers but if there was confidential material then the personal would shred it themselves. However,there would not be more than 8-10 bags a month at the most. xxx buc:freddie Smith After Francke was killed and they were doing the investigation, the dome bldg. area was roped off and no inmates were allowed to work there.
So from the time of Francke's death on Tuesday the 17th until Monday the 24th, when the inmates returned to work at the dome, some one was doing some shredding.
When Freddie came back to his office there were lots of 40lb bags of shredded material. Freddie and another inmate threw the bags away and he counted them. There were 23 bags. Freddie also saw a 7-up can on his desk. He took the can and put it between his desk and the wall. Later on he told the police about it, but the can was still there months later. Freddie figured they could have gotten finger prints off of it to see who was doing the shredding. xxx buc:freddie Smith Freddie was interviewed at the state police office on three occasions. Each time they talked to him Freddie got the feeling that they were not interested in what he could tell them and just what he knew as apposed to what he knew about he Francke killing. xxx buc:freddie Smith Freddie stated that he has talked with Phil Stanford many times. He has also talked with Pat and Kevin Francke. Pat told Freddie that he was talking with Michael in the weeks before his death.
Michael told Pat that he was working with a 357 mag. and a riot shot gun. He also said that he had discovered a criminal element in the system and the top four heads are going to roll. He also said that the deputy was going to roll. The deputy at that time was Richard Peterson. No further information at this time.

On 8-30-90 this investigator contacted Thompson at the Marion County Jail. He stated that he was arrested on May 10th,90. He was put in "E" block. Also in "E" block was Michael Keerins. At the time of this interview Thompson was in "D" block. buc:alan thompson Keerins was in the jail when Thompson came there. He spent four months in "E" block with Keerins. xxx buc:alan thompson It is a well know fact around "E" block and the jail in general that Keerins in involved in the Francke case. Keerins talks about it often. He walks around the block like he is the king. He talks about how he has contact with the DA. He talks about how he can and does call the DA when he wants. Keerins has made statements that he is going to call the DA and then he goes and makes a call on the phone and when he returns he tells how he talked to the DA. Keerins in very boastful about this association. xxx buc:alan thompson Thompson stated that the DA is also putting money on Keerins books. He knows this because Keerins does seem to always have money to spend, he says that they put money on his books and Thompson knows that Keerins mother doesn't have the money to give him. Thompson also told about Keerins running shoes. It is a big joke in the prison. Keerins has these sneakers that cost $139.00. He boasts about how the DA bought him the running shoes and showed him and another inmate the price tag. xxx buc:alan thompson One day Thompson and another inmate, Ed Tucker were sitting at a table in the cell area talking about Keerins and his association with the DA. They were near Keerins cell. Kerrins came out of his cell and told them;"if it wasn't for him being paid, Gable would be walking free". Thompson states that this statement by Keerins was boastful like he was getting money out of it. xxx buc:alan thompson Thompson also said that Keerins is writing a book about his association with this case. He let Thompson read it. It starts when Keerins was in Jail with Gable. Thompson also said that Keerins drew a picture of a rat in the book papers. This was signifying Gable as a rat. xxx buc:alan thompson
Thompson states that He doesn't know Shorty. He also doesn't know Gable. He knows who he is but has never talked to him, nor had any contact with him. xxx buc:alan thompson Thompson also told me about talking to another investigator from the Gable defense. (He didn't remember his name, but the description seem to fit Tom.) After that interview he returned to "E" block. Apparently word got around that Thompson was talking to an investigator from the defense because Keerins approached him and asked him about it. Keerins then went to the phone and called the DA. He returned to Thompson and told him that the DA will be up to talk to him. (They were suppose to come and see him the week prior to this interview, but they hadn't come yet.) xxx buc:alan thompson Keerins told Thompson that he could make arraignments to get Thompson out of jail or get his sentence cut if he would detract his statement to the Gable defense. I asked Thompson if Keerins knew what he had told the defense. He said that he didn't tell Keerins but Keerins figured it out because he (Keerins) knew what he had said and he knew it was "the opposite side". No further information at this time.

The witness said he was not being represented bycounsel. xxx buc:dennis gause Mr. Gause reported meeting Jodie Swearingen, "from the dope circle, from the streets." Mr. Gause was questioned about his knowledge of a body being seen in the back of Cappie Harden's pick-up. The witness said there was never a body in the back of Mr. Harden's pick-up that he was aware of. He said he had told Shellie Thomas that he had seen a body at Mr. Harden's in an attempt to scare her into not going over to Mr. Harden's house. The witness said that Ms. Thomas told her friend, Brenda Lynn, about his comment and Ms. Lynn told Ms. Swearingen about the body. He stated, "It was a lie." xxx buc:dennis gause The witness was then questioned about how gossip travels in the drug community in relationship to his statement about the body in the truck. He was asked if this was how the story got started about Mr. Gable committing the Francke murder. He stated that this was exactly how it happened. As an example the witness said, "If I said something about Shorty to someone it would get to him before I could drive over to his house and he would be on the phone talking to someone about what I had said." xxx buc:dennis gause The witness said he never had any discussions with Jodi Swearingen about a dead body in the back of Harden's truck. He also didn't have "tears" in his eyes with any discussion with her. Gause said any statement that Ms. Swearingen may have made about this are not true. xxx buc:dennis gause Continuing, the witness said that Mr. Harden came over to his house and asked him about the statement and he told Mr. Harden he was only trying to keep Ms. Thomas from going over to his house because he felt Shellie was getting too involved in the drug world and didn't want her over there. Mr. Gause stated, "This one isn't real." He was referring to the body in the back of Mr. Harden's truck. xxx buc:dennis gause The witness reported talking to the police "10 to 15 times." During one of the interrogations the witness was asked about having seen a body in the back of Mr. Harden's truck. The witness said he told the police "it was a lie." xxx buc:dennis gause Regarding the Gable case the witness stated, "everyone wanted out for either money or to get their crime reduced or freedom, money or freedom." xxx buc:dennis gause Mr. Gause said he was in the hole while at Marion County Jail and Mr. Harden was also there. Mr. Gause said, "I sat with Shorty and we talked, everyone was talking and scammed and we were all looking at O.R. I was already convicted and sentenced but hoped I could get out." Shorty planned to say, "he was involved and he said he got a telephone call from Jodi to pick her up and to get them - Frank and her, and Frank admitted to killing Francke." buc:dennis gause The witness said this was a scam and something that Mr. Harden told him he was going to tell the police. Mr. Gause said Mr. Harden told the police this story. xxx buc:dennis gause The witness reported talking to the police about Mr. Harden's story and they confirmed Mr. Harden's statements. Mr. Gause stated that each time Mr. Harden was interviewed he was called in right afterwards and this is how he found out what Mr. Harden had told the police. xxx buc:dennis gause However, the witness said Mr. Harden told several different stories. Mr. Gause said Mr. Harden originally told him that he didn't know anything about the murder and was not involved in it. The second story was that Mr. Harden had pick Mr. Gable up and had dropped him off at the murder scene. His third story was he had picked up Ms. Swearingen at the murder scene and had left Mr. Gable there. The fourth story was he had seen Mr. Gable inside the car at the murder scene when the dome light came on in the car. The witness added that this story was implausible because Mr. Harden had only seem Mr. Gable once and the witness questioned how was he to have recognized him at night with only a dome light on. xxx buc:dennis gause Mr. Gause said he took a polygraph regarding the Francke murder. The witness said be thought he was going to be tested on his statements about his and Bill Storm's "story." The witness said he was surprised when he was questioned about his involvement in the murder and his knowledge of other's involvement instead of being tested only on their story. It was his impression that the police thought he might be involved in the killing. xxx buc:dennis gause Mr. Gause said Robert Cornett was the first person to bring up Gable's name in connection with the murder. Mr. Cornett was the first one to direct the police's attention to this drug group, "that level of drug users and criminals." THe witness said that prior to this the police only knew a murder had been committed and now they had a group of suspects to look at. xxx buc:dennis gause Mr. Gause said he and Bill Storm then made the decision to fabricated a story in hopes of a reduced jail sentenced. It was shortly after that the witness ended up in "the hole with Shorty." This is when the witness told Mr. Harden of his plan with Bill Storm to scam the police. The witness said, "When Shorty said that he didn't know anything about it (the murder) I told him to play it up and get us out (of custody). xxx buc:dennis gause Mr. Harden then planned a "story" of his own to tell the police. Mr. Harden's original story to the police was to help get his time reduced, according to the witness, or charges dropped. Mr.Harden's story then progressed to the point that he would get some money. The witness said he later learned that Mr. Harden was calling himself, "The million dollar baby." xxx buc:dennis gause Regarding Ms. Swearingen the witness stated, "She is not honest and rips everyone off." Mr. Gause said everyone he knows would say she is a liar and has a reputation "as a liar, tramp and a thief." He added, "She is known as scroddy Jodi." He said that when she was called this to her face she simply laughed. xxx buc:dennis gause Mr. Gause suggested that we look at the two administrators directly below Mr. Francke in the Corrections Department. He felt it was suspect that they left when they did. He said guards were responsible for bringing drugs into the institutions and some had been fired for it. He strongly felt that Mr. Francke's murder was connected to drug corruption in the Corrections Department.
The witness was then questions about why he thought Mr. Gable's name was brought up. He said that Mr. Gable was a snitch. Mr. Gause stated Mr. Gable had no friends in the drug system because he was a snitch and because he was a nobody had no connections with administration. In addition Mr. Gause believed that because Mr. Gable "was a punk, someone's wife" he was an easy target. xxx WITNESS INTERVIEW REPORT (#3) ATTORNEY: Bob Abel/ John Storkel CASE: State vs. Gable, Frank xxx INTERVIEWED: Dennnis Gause Tillamook Forestry Camp Tillamook, Oregon xxx On 12-8-90 I contacted Dennis Gause at the Tillamook Forestry Camp where he is incarcerated. I subpoenaed him for the above trial. I gave him a copy of a report of our interview of 11-17-90. I asked him to review this report and let me know if there are any inaccuracies or if he would like to change any statements. After reading the report he stated that it was accurate. I asked him if this was correct in what he had told investigator Hamilton and myself. He indicated yes" it was. Dennis stated that the only thing in the report that bothered him was the last paragraph about the correction corruption. He said that he was a little worried because it was in our report. He commented that if the corrections people saw that he made that statement he would be in trouble. he felt real nervous that he was in the custody of the corrections and he was making statements about them. I assured him that our report was for our use and the attorneys would be the only ones who would read the information. He also stated his concern about the papers getting those statements. I also assured him that they would not get any statements he made. xxx buc:dennis guase I asked him if he would sign the report, under penalty of perjury, indicating that he would testify to the information in it and its accuracy. He stated that as long as he was in prison he didn't want to sign the report and he didn't want to testify to these statement. He stated that if he testified then he might be labeled a snitch. He figured that if he was labeled a snitch that some guy might think he was "bad" and try to "shank" him. xxx buc:dennis guase
Dennis stated that he would have no problem testifying if he was released before the trial, when he had to testify. He would be under no pressure if he wasn't in jail. xxx buc:dennis guase At this point he looked at the subpoena and said it was good that it said, "testify for defendant". This way he could show others in prison that he was testifying for the defense and not a snitch for the prosecution. xxx buc:dennis guase I asked him what he was going to say if he was in custody and had to come to trial. He stated that he wouldn't say anything. I indicated that he would need an attorney with him if that was to happen. I also told him that Cynthia and I would have to testify to his statement if he would not say them. xxx buc:dennis gause However it should be noted that he never did say he would deny or lie about the statement. He just said that he would not testify. xxx buc:dennis guase I offered him a copy of his statement to have with him. He declined it saying that he didn't want it around for the other inmates and the corrections people to see what he had to say. xxx buc:dennis guase He stated that I could call him January 91, because he would have his parole hearing at the end of December. He stated that if he received a release date prior to his testimony he would sign the report. I indicated that I needed it signed under penalty of perjury. They were going to talk with him cause Mike Keerins told him they were. He was in the same cell block as Keerins. Keerins was doing continually talking about the Francke case and where he (Keerins) had been on the night Francke got killed. Greg went on to say that Keerins was putting pressure on him (Greg) to remember what had happened that night. Greg indicated to me that he did actually remember what had happened that night and that Keerins was correct in what he was telling Greg, except for one point. xxx buc:greg johnson Keerins had told Greg that the O.S.P. officers were coming to talk with him (Greg) so Greg could tell them the same thing that Keerins was telling them. Greg indicated to me that he didn't want to talk to the cops. He asked me if he had to talk to them. I told him that It would be against the law for me to advise him not to talk to them. I told him that the decision was his. He stated that he didn't really want to talk to them but he felt that they would be putting the pressure on him to talk. I then suggested that he tell them, he will talk with them; but he should request that Tom McCallum be present. I said, that way they wont pressure him, and in fact I would be willing to bet that they wouldn't talk with him at all, if McCallum was present. He agreed that was what he would probably do. xxx buc:greg johnson Greg went on to tell me the things Keerins was saying. He indicated that Keerins was doing all the talking and Greg was listening. He didn't really want to tell Keerins anything, he just wanted to see what Keerins was saying. xxx buc:greg johnson Keerins reminded him about all the people who were together the night of the 17th. There was Mike Keerins, Greg Johnson, Francis Jones, Sandy Duncan at Jones' and Duncans' residence. Chris Keerins and another person who was with Chris came over to the house also. They were all hanging out there. Tim Natividad came over to the house. xxx buc:greg johnson Greg stated that he agreed with all the above that Keerins said. It is the next part that he doesn't agree with. Keerins says that Tim Natividad came over and they stayed together, with Tim for a long time. However, Greg says that Tim came over around 6:30 or so and stayed for a very short period of time. Greg said that it was real strange the way Tim acted at that time. He seemed to be in a rush and acted worried and was real sweaty. xxx buc:greg johnson Greg went on to state that he remembers it was the night that Michael Francke got killed because when the cops were looking for Chris Keerins later on, to question him about the night of the murder, he remembered thinking, wow Chris wasn't involved because he was with us that night. xxx buc:greg johnson Greg stated that Keerins was trying real hard and putting pressure on Greg to specifically remember that Tim had stayed with them for a while. This way Tim had an alibi for that night. Greg stated that he just couldn't lie. He had to tell the truth.

She got the answering machine but didn't leave a message. buc:karie rothchild She stated that the last time she saw Tim Natividad he was telling her about his new hair cut or a new mustache, she is not certain which. buc:karie rothchild She also remembered that he had given her some jewelry she is not sure but it was either a diamond or opal buc:karie rothchild I asked her if she remembered the photograph that I had shown her. She stated yes. I asked her if she remembered seeing him with Natividad. She indicated that she cant remember him being with Natividad. However, she did recognize the picture as being someone she had seen before. She just couldn't remember who it was with, where or under what circumstances. buc:karie rothchild I then asked her if she could tell me more details about the murder that Natividad committed in her presence. She stated that she could picture the event in her mind. She was sitting at the kitchen table talking to a girl she had just met. Natividad was in the living room when he shot the guy. She saw Tim carrying the guy past her and out the kitchen door. He took the body to a car and put it in the trunk. buc:karie rothchild She stated that she was very scared at the time and didn't say anything. She felt that if she had said something she might be killed. She didn't want to bring any attention to her. Even after her and Tim drove away she never said anything because she was still scared. buc:karie rothchild Karie stated that after that they left and Tim changed his clothes in his van. xxx No further information at this time.

DATE OF INTERVIEW: 6-8-90 xxx buc:melody rothchild garcia I contacted Melody to gain information about Tim Natividad. She read the police report of Det. Pecyna dated 8-6-89 from the interview with her on 7-31-89. She stated that it was quite accurate and she had no corrections. xxx buc:melody rothchild garcia Melody is from Ca. and Utah. She has been in Oregon about five to six years. She is married to an Oregon State Penitentiary Inmate, Konrad Garcia. He has been in the prisons system for about thirteen years. Melody has three daughters and one son whom all live in Utah. xxx buc:melody rothchild garcia Melody met a family of another inmate during her visits to see her husband. This friends name is Pat Sacre. Melody decided to help them and let her and her family live with Melody for a short period of time. Pats husband, Steve Sacre was in prison with Melody's husband. This was around July or August of 1987. xxx buc:melody rothchild garcia Pat was to only stay a short period of time. However she ended staying for a long time. Pat got involved with meth. She began hooking on the streets to support her habit. xxx buc:melody rothchild garcia The more Pat got involved in meth the harder it got for Melody. Pat wouldn't do her responsibilities. It got to a point where Pat began ripping off Melody. This is when Melody kicked her out. xxx buc:melody rothchild garcia One time Pat brought home a bunch of stolen items such as guns and VCR and stereo. Melody gathered up this stuff and took it to the State Police. She spoke with Det. Tindle. They stated that they couldn't help her. They weren't even interested. This surprised Melody. xxx buc:melody rothchild garcia When Pat became involved in meth, the meth crowd started coming around the house. Two of the people who came around were Robert Nichols Zink and Dave Robie. These two were a couple of the nicer ones. Both knew Natividad. They would talk about "Rooster". This was a nickname of Natividad. xxx buc:melody rothchild garcia They talked a lot of Rooster and told about how tuff he was and all the things he did. They talked about how he tied some guy up for the whole weekend to collect a debt from him. They told her that she should meet him. xxx buc:melody rothchild garcia One day Natividad came over to the house. He came in like he was at home. Like he had known Melody for a long time. This was around June 1988. He came into the bedroom where she was. He said that he had heard of her and was wanting to meet her. She asked who he was. He told her that he was Tim Natividad. Apparently both Zink and Robie had told Natividad about Melody. xxx buc:melody rothchild garcia From the very start Natividad acted real friendly with Melody. It was like they had been friend for a while. He told her that he had done time at OSP and knew her husband, Garcia. That night he talked on the phone with Garcia and talked to him about remembering him. They decided they would get a pass for Natividad to visit Garcia. For the next couple of month they tried to get one but was never successful. xxx buc:melody rothchild garcia As it turned out Melody found out that Natividad didn't do time at OSP nor did he know her husband. Melody felt that was odd in that he had made such a point of that. Natividad also said that he had to report the next day to go into prison. However he showed up and made some comment about his attorney getting a set over for him. xxx buc:melody rothchild garcia That first night Natividad talked to Melody about getting rid of some guy. Natividad wanted Garcia to do the job. They talked on the phone about it. xxx buc:melody rothchild garcia This was during the time when Garcia was going to have his parole hearing and he was going to be released. xxx buc:melody rothchild garcia Natividad talked bout getting rid of some guy. He said thing like he had to so something. Some one has to go down. He told Melody that this person would be someone that she would be happy about. This person would help her with her problems. At the time the only real problem she had talked to Natividad about was her husband getting out of prison. He was suppose to get out several times but it seemed like there was always something that got in the way. So when Natividad said this she felt that the person he had to get rid of was in the corrections system. buc:melody rothchild garcia Natividad talked on many occasions about getting rid of the guy. He didn't mention who it was and Melody never asked. One time when he came over he was talking about it. As he was getting ready to leave he was sitting on his motorcycle in the driveway. He was reeving the motor up. Melody asked him who the guy was that he was going to kill. Over the sound of the motor- cycle engine Natividad was saying something. The only word she heard was Frank. She didn't relate this name with anyone she knew. She had heard Michael Francke's name before but she didn't know who he was and certainly didn't think of him when Natividad said the name. xxx buc:melody rothchild garcia Melody stated that Natividad talked and acted real rough. He was always talking about violent things. He always had a knife on him and he was into knifes. He always had a ten inch knife strapped to his leg. xxx buc:melody rothchild garcia Melody remembers that Natividad came to the house the night before Michael Francke was killed. Natividad was crazy on meth and he was wild eyed. Melodys daughter went to the door but she was scared so she put him off saying that Melody was not home. He left after a few moments. It was the next day that she heard of Francke dying and she felt that this was the guy who was supposed to die. xxx buc:melody rothchild garcia One time Natividad came over and he had lots of guns in his car. He showed Melody. She saw a colt 45 on the front seat and some gun handles under the seat. In the back seat he had a sawed off shot gun. He showed her in the trunk where there were other guns and shells. xxx buc:melody rothchild garcia The word on the street was that Natividad had a white slavery ring of young girls. He would meet the girls, get them hooked on drugs and then turn them into prostitutes. He would use them for sex and also make porno films. xxx buc:melody rothchild garcia Natividad was always after Melodys daughter. He liked her and she liked him. Melody always had to keep an eye on them. xxx buc:melody rothchild garcia Natividad told her about beating and stabbing a guy in a van at Jory park. Melody was told by a guy named Graham that he saw Natividad kill the guy. Natividad came over to Melodys house and he was wearing a white suit. This suit had blood on it. He took it off and stacked it in their closet. PERSON INTERVIEWED: Melody Rothchild Garcia DATE OF INTERVIEW: 6-12-90 xxx buc:melody rothchild garcia I again contacted Melody to gain more information of Natividad. xxx buc:melody rothchild garcia Melody stated that Natividad was trying to swoop on her daughter Karie Anne Rothchild. At the time she was only fourteen years old and she looked older than her age. Natividad really liked her and tried on several occasions to be with her. Melody had to be aware of where she was. Karie liked Natividad also. xxx buc:melody rothchild garcia Melody was careful because she knew of Natividad's reputation for taking younger girls. She recalled one day Natividad spent a good part of the day at her residence. All of a sudden both him and Karie were gone. They were gone for about twelve hours. During that period of time Karie called her quite often. Melody never did find out where they went. xxx buc:melody rothchild garcia Melody remembered one day that Natividad came over with another person. He never introduced this person. They came in the house for a short period of time and just left. The guy didn't say anything but just stood there while Natividad did what he needed to do. xxx buc:melody rothchild garcia This particular time was odd to Melody in that Natividad would often bring people over with him but they always stayed in the car. This time this guy came in the house. xxx buc:melody rothchild garcia The second thing was that it was obvious that this guy was not Natividads type. This guy was a straight looking guy, business man type. His hair was too short, he was not scruffy enough and he looked too clean to be with Natividad. Melody stated that she was very alert to this type of stuff. It really seemed out of the ordinary. xxx buc:melody rothchild garcia Melody didn't think a whole lot of this other than just being aware that it happened. Later on she was looking at a newspaper and saw the article and a picture of Scott McCallister. She immediately recognized him as the person who came to her house with Natividad. She was completely convinced that they were the same person. xxx buc:melody rothchild garcia Melody indicated that she didn't talk to her daughter about Natividad or McCallister so she doesn't know what Karie may know concerning this. However we can talk with her when she come to Salem this summer. xxx buc:melody rothchild garcia After Melody read about the porno case that McCallister is involved in she felt that it was real obvious that they were friends. Natividad was heavily into porn with younger girls and so is McCallister. Now she could see the connection. xxx buc:melody rothchild garcia She also feels that McCallister was protection Natividad with his dope deals. She could never figure out how Natividad didn't get busted. He did so much dope, and knew so many people and supplied so many people with dope. She just figured that he had someone high up protecting him. xxx buc:melody rothchild garcia Melody stated that she felt that her husband Konrad Garcia was being set up by Natividad to kill Francke. However when his parole hearing was cancelled and Garcia got eighteen more months added to his sentence he was unable to do it. She figured that Natividad went ahead and did it on his own. This opinion is based on the many conversations she had with Natividad and the conversations he had with her husband about getting rid of some guy

buc:mike keerins Mike stated that he knew Gable from the joint. They weren't really friends but he just knew him on and off for a couple of years. He stated that Gable hung with black at the joint. He didn't know the name Gary Davis or Mudflap. xxx buc:mike keerins Mike stated that he got out of the joint the first time 12-15-88. After that he saw Gable on the streets. He remembers one time that he saw Gable at a store. Gable approached him and threatened him about Chris. Gable said something about Chris telling the cops about Gable doing it. (Francke murder) xxx buc:mike keerins Keerins went on to say that he was locked up at Marion Co jail May 3, 1989. He was in the same area as Gable. It was in the latter part of May that Gable made statements to him. xxx buc:mike keerins Gable said that his wife was telling on him for the murder. He said that he was in the car and Francke came up behind him and was trying to hold him for the cops and was giving him shit. xxx buc:mike keerins Gable then grabbed his knife and stabbed the guy and took off running. Gable showed the motion to Keerins. Gable said that he didn't think he killed the guy. xxx buc:mike keerins At this point the guards asked us to leave because it was lock down. We asked Mike if we could come talk with him again. He said that he wanted to call the DA and ask them if I should talk with us. He said that we could come back and check with him to see what they said. xxx No further information at this time.

WITNESS INTERVIEW REPORT (#3) ATTORNEY: Bob Abel/ John Storkel CASE: State vs. Gable, Frank SUBJECT: Jodie impeachment. INTERVIEWED: Rick MacDonald Oregon State Correctional Institute. SID #-7345077 Counselor: Dick Tissue 373-0173 CRIMINAL HISTORY: 1986 4-charges re: Possession 2-charges re: Delivery. buc:rick macdonald On 10-22-90 this investigator contacted Rick at OSCI. He stated that he knew Jodie from the streets. She was ridding around with him during the time the police were looking for her. He stated that he did take her to St. Helens and left her at Don Warrens house. xxx buc:rick macdonald I asked him about some of the statements she had made to him about the murder of Michael Francke. He immediately stated, "she just wanted her name in lights". "She just wanted the people in the click to think she is good and acceptable". " She wanted to enhance her image in the group so they would accept her more". xxx buc:rick macdonald He stated that he didn't believe her much because she is a tweak. xxx buc:rick macdonald He stated that she did tell him that she was in bed with a guy and he said that he was going to kill her like he killed Francke. She didn't say who that person was. xxx buc:rick macdonald He also stated that Jodie told him that she had talked to the cops and "told them something to get them off her back". She also said, "anything they wanted to hear". She was talking to them and faked being sick and told them she would come back tomorrow, but she didn't show. It was at this time the cops started looking for her and she was with Rick part of the time. xxx buc:rick macdonald At this time I read the police report to him. (see attached report) Rick made the following statements about the report. He stated that Brent who is mentioned in the reports is Brent Mole and he lives in Amity. xxx buc:rick macdonald He also said that at the time he was talking with the police he didn't realize that he knew Frank Gable. But after talking with a friend he now remembers he did know Gable. The friend told him about a Frank that would come over to the friends house while Rick was there. Rick just didn't know his last name. The friend also reminded Rick about a incident where Gable helped the friend. The friend was talking to Gable about not having any money to pay his rent. A few days later Gable came over and gave this friend some money for the rent. xxx buc:rick macdonald Rick went on to state that Jodie told him that she was there when Francke was killed. She never did say who did the murder. However she did say it was not Frank. Again Rick told me about Jodie being threatened while in bed with a guy but she didn't say who the guy was. xxx buc:rick macdonald I then asked Rick how this subject was brought up and how she came around to talk about it. He said that around the time he was with Jodie the cops were looking for her real hard. They were busting lots of people who were associated with Jodie and drugs. They wouldn't necessarily go into house but they would be watching the different houses and when people left they would be stopped. At least seven of their friends were busted with drugs. xxx buc:rick macdonald The police seemed to be either just ahead of them or just a step behind. They would go to houses that the cops had just left looking for Jodie or they would leave a house moments before the cops arrived. Rick was hearing about this for over a period of weeks. He also knew that they wanted to talk to Jodie about a Frank Gable. He knew the last name from hearing it around but again he didn't associate Frank Gable with the Frank he met at the friends house. xxx buc:rick macdonald Rick had asked Jodie what was going on. Their friends were being busted, or popped or pulled over and the houses were being surrounded. He told Jodie that she had to tell him the truth because the situation was bull shit. He also told her that he may be able to help if he knew the truth. Jodie tried to avoid telling him, but he insisted. She then told him, "It wasn't Frank. I just said that. I told them what they wanted to hear". She also told him about faking that she was sick. xxx buc:rick macdonald He then asked her who did it, but she wouldn't say. She just clammed up. He then told her that it wasn't important who did it but her involvement is. He told her that she had to clear it up somehow cause everyone was getting busted because the cops were looking for her so hard. xxx buc:rick macdonald At this point he accused her of "not knowing shit". He stated that she was "just high" and was trying to be a "big wheel"and just "tweaking". xxx buc:rick macdonald Jodie said he could believe what he wanted. Then she began to write in a notebook she had. He said that she often carried a spiral notebook around with her and wrote in it often. xxx buc:rick macdonald I then asked him if there was anything else he felt was important that I hadn't asked him. He said that he felt the way Jodie handled drugs was important. He added that it reacts on her harder than others. It is like she is on LSD. She hallucinates and it affects her visual perception and her feeling perception. xxx buc:rick macdonald At this point I reviewed my note of our interview with him and if he agreed to their accuracy to initial each page. (see attached notes.)
